New Privacy Arrangements

The long awaited proposed amendments to the Privacy Act 1988 (Cth) were released by the Cabinet Secretary Senator Joe Ludwig on 24 June. The draft bill has been referred to the Senate Finance and Public Committee, this Senate Committee is holding consultation in relation to the draft bill and AICM will be lodging a submission in response.

The reforms to the Privacy Act will be undertaken in two stages. The first stage which these latest amendments refer to will combine the current National privacy Principles and the Information Privacy Principles (which have only had application to government agencies) into one set of principles which will be called the Australian Privacy Principles. These new Privacy Principles will apply equally to both private and public sector organisations.

There will be further changes which will be released over the coming months which will address amongst other things:

  • Comprehensive credit reporting
  • Revisions to the credit reporting code of conduct
  • Extension of the Privacy Principles to small business

AICM will advise members on each stage of this reform process.

Final reporting date to the Federal Parliament for these reform as is July 2011.

Privacy Reforms: Credit Reporting

 

In January 2011 the Federal Government released the Exposure Draft Bill which details the Government's intended direction in relation to reforms relating to credit reporting including the introduction of comprehensive credit reporting.

The Exposure Bill was accompanied by a Companion Guide to the the Privacy Reforms Credit Reporting which is designed to explain in 'plain English' the basis for the proposed legislative change.
